La illegittimità costituzionale sopravvenuta della sanzione amministrativa non travolge il giudicato. Note a margine di Corte Cost., 24 febbraio 2017, n. 43
31 Maggio 2017
In the recent decision n. 43/2017, the Constitutional Court established that the judgment on sanctions, qualified as administrative but criminal in nature, for the purpose of the Articles 6 e 7 ECHR, can not be overturned if the authorizing statute is subsequently found unconstitutional. This paper aims at addressing the problem of the relationship between the effects of the uncostitutional statute and the power to impose administrative sanctions. Moreover, it intends to verify if the nullum crimen sine lege principle is respected and if there are legal remedies to recover the penalty.
