Diritti: cioè? Dietro i diritti, oltre le corti

The essay analyzes the different perspectives concerning the guarantee of fundamental rights beyond the Courts. The main question deals with the growing difficulty in identifying rights and the subjects called to guarantee them. These problems arise from the long-lasting struggle for rights, which does not end with the adoption of a constitution: the open texture of the catalogues of rights causes a permanent conflict around their meaning.
