The article comments judgment n. 9006 of 2021 of the Italian Court of Cassation in its highest composition, regarding the effectiveness of a judicial decision concerning so-called legitimizing adoption by a homosexual couple. The article draws upon judgments n. 32 and 33 of 2021 of the Italian Constitutional Court, also regarding cases of homosexual couples. The systematic interpretation of the three decisions indicates possible solutions to lawmakers, who are called upon to protect the best interest of the child within parenthood projects arising from surrogacy (in cases of male homosexual and heterosexual couples) and from assisted procreation in cases of female homosexual couples.
